1. Acceptance of Terms
By downloading, installing, or using Import GPX from Strava, Komoot (referred to as "the App", displayed as Import GPX on mobile and GPX Follower on the Wear OS watch), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the App.
These Terms apply to both the mobile application and the companion Wear OS application.
2. Description of the App
The App is an Android and Wear OS application that allows users to:
- Import GPX routes from local files or from third-party platforms (AllTrails, Komoot, Outdooractive, Strava, Wikiloc)
- Display routes on a map and view elevation profiles
- Follow routes in real time using GPS navigation, including on a connected Wear OS watch
- Download offline map tiles for use without an internet connection (Premium feature)
The App is intended for personal, non-commercial outdoor and fitness activities.
3. Licence
Subject to your compliance with these Terms, Optisearch grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App (Import GPX on mobile and GPX Follower on Wear OS) on Android devices that you own or control, solely for your personal, non-commercial purposes.
You may not:
- Copy, modify, or distribute the App or its source code without written permission
- Reverse-engineer, decompile, or disassemble the App
- Use the App for any unlawful purpose
- Sublicense or sell access to the App
4. Free and Premium Features
The App is available in two tiers:
Free tier
- Import routes from supported third-party services
- Send a route to your Wear OS watch
- Basic map display and navigation
Premium tier (subscription required)
- Elevation graph display
- Remaining distance indicator
- Offline map download on the Wear OS watch
The feature set may evolve over time. We reserve the right to add, modify, or remove features from either tier, with reasonable notice where practical.
5. Subscriptions & Billing
Premium features are unlocked through a recurring subscription offered in two plans: monthly and yearly. Subscriptions are processed entirely by Google Play Billing and are subject to Google Play's Terms of Service.
Free trial
New subscribers may benefit from a 7-day free trial on both plans. The trial is available once per Google account. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for the selected subscription plan.
Renewal & cancellation
Subscriptions renew automatically at the end of each billing period. You may cancel at any time through the Google Play subscriptions page. Cancellation takes effect at the end of the current paid period; you will retain access to Premium features until that date.
Refunds
All refund requests are handled by Google Play in accordance with their refund policy. We do not process refunds directly.
Price changes
We reserve the right to change subscription prices. Google Play will notify you before any price change affects your existing subscription, and your renewed consent will be required where applicable.
6. Third-Party Services – Disclaimer of Responsibility
The App integrates with publicly accessible data from third-party outdoor and fitness platforms: AllTrails, Komoot, Outdooractive, Strava, and Wikiloc. The App is independent and has no official partnership, affiliation, or endorsement from any of these services.
By using the import features, you acknowledge that:
- You are responsible for complying with the terms of service of the third-party platform you are importing from
- You will only import routes that you are legally entitled to access
- The App only accesses publicly available route data on your behalf; it does not log in to or scrape private data from any platform
The App also uses map tile services (including Komoot tile servers and Mapbox) for map rendering. Availability and quality of map data depend on those providers.
7. User Responsibilities & Acceptable Use
You agree to use the App responsibly and acknowledge that:
- GPS accuracy is not guaranteed. Do not rely solely on the App for navigation in hazardous environments. Always carry appropriate maps and safety equipment.
- You are solely responsible for your own safety during any outdoor activity.
- The App must not be used in a way that violates any applicable laws or regulations.
- You must not attempt to circumvent any technical restriction or access Premium features without a valid subscription.
8. Intellectual Property
All intellectual property rights in the App, including but not limited to the source code, design, graphics, and trade names, are owned by or licensed to Optisearch. Nothing in these Terms grants you any rights to use our trademarks, trade names, or logos.
Routes and GPX data imported from third-party services remain the intellectual property of their respective owners.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- Accuracy, reliability, or completeness of any routes, map data, or navigation information
We do not warrant that the App will be compatible with all devices or future Android versions.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Optisearch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of, or inability to use, the App
- Any error, inaccuracy, or omission in route or navigation data
- Failure or unavailability of third-party services
- Personal injury or property damage resulting from outdoor activities performed while using the App
- Loss of data or device damage
In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability will be limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Optisearch from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the App or violation of these Terms.
12. Termination
We reserve the right to terminate or suspend access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or us.
If you wish to stop using the App, you may simply uninstall it and cancel your subscription (if any) through Google Play.
13. Changes to These Terms
We may revise these Terms from time to time. Material changes will be communicated through an in-app notice or by updating the "Last updated" date on this page. Continued use of the App after changes have been posted constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the competent courts of Belgium.
